Terms of Service.

Captiv generates captions and hashtags for social media posts. You upload media (an image, carousel, or video) and Captiv uses AI to analyze it and write caption options in your voice, tuned per platform.

You can try Captiv without creating an account. Adding an email creates a free account and lets you keep your history and voice profile across devices. You are responsible for activity that happens under your account and for keeping access to your email secure. You must be able to form a binding contract to use the service.

Free. Anonymous visitors get 3 free credits. Free accounts get 5 credits per month. Limits may change; we will not lower them for a billing period you have already started.

Paid plans. Starter is a $15/month subscription with 50 credits per month (a photo or carousel is 1 credit, a video is 2). Pro is a $40/month subscription with 150 credits per month plus priority support. Studio is a $50/month subscription with 250 credits per month. Enterprise plans have custom pricing set by agreement. Some features require a paid plan: voice-matched captions, video and carousel analysis, and creative direction. Subscriptions are billed through Stripe and renew automatically each month until you cancel. You can cancel anytime from the billing portal; cancellation takes effect at the end of the current billing period, and you keep paid access until then. We do not offer refunds for partial months.

You agree not to:

• upload or generate content that is unlawful, or use the service for unlawful purposes;
• upload media you do not have the rights to use;
• abuse, overload, or interfere with the service, or attempt to bypass usage limits;
• reverse-engineer the service or scrape or access the API by automated means outside the product itself.

You own your uploads, and you own the captions Captiv generates for you. You grant us a limited license to store and process your uploads and generated text solely to provide the service to you. For example, we send your media to our AI providers for analysis and use your kept and edited captions to build your personal voice profile.

You represent and warrant that you have all rights necessary to upload and process the media you submit, including any needed permissions from people who appear in it, and that your uploads do not infringe anyone else's intellectual property, privacy, or publicity rights.

Captions and hashtags are generated by AI. They can be inaccurate, incomplete, or off-tone. Review everything before you publish it. We make no guarantee about the accuracy of outputs or the engagement, reach, or performance of anything you post.

Captiv is provided "as is" and "as available." We may change, suspend, or discontinue features or the entire service, and will give reasonable notice of material changes where practical. We do not promise uninterrupted or error-free operation.

To the maximum extent permitted by law, Captiv will not be liable for indirect, incidental, special, or consequential damages, or lost profits or data. Our total liability for any claim relating to the service is capped at the amount you paid us in the 12 months before the claim arose.

You agree to indemnify and hold Captiv harmless from claims, damages, and reasonable legal costs arising from content you upload, your use of the service in violation of these terms, or your violation of any law or third-party right, including the rights of people appearing in media you submit.

Most concerns can be resolved quickly by emailing supportcaptivsocial@gmail.com, and we ask that you contact us first. If we cannot resolve a dispute informally within 30 days, you and Captiv agree that any dispute arising out of these terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court or seek injunctive relief for infringement or misuse of intellectual property.

Class action waiver. Disputes will be arbitrated on an individual basis only. Neither you nor Captiv may participate in a class action, class-wide arbitration, or representative proceeding.

Your right to opt out. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these terms with the subject line "Arbitration opt-out". Opting out does not affect any other part of these terms.

You can stop using Captiv at any time. We may suspend or terminate access if you breach these terms or use the service in a way that harms it or others. If we terminate a paid account without cause, we will refund the unused portion of the current billing period.

We may update these terms as the product evolves. If a change is material, we will make reasonable efforts to notify you, for example by email or an in-product notice. Continuing to use Captiv after changes take effect means you accept the updated terms.

These terms are governed by the laws of the State of Texas, USA.
